Legislative Veto SB 7

Montana Legislature alert. (I'll add this to all post that are very strictly about the Legislature for those not interested.)<br />nWith the Montana Legislature in session I have been paging through the <a href="http://laws.leg.mt.gov/pls/laws07/LAW0217W$BAIV.return_all_bills">bills proposed</a> and a few caught my eye. Here is one.<br />n<br />n<a href="http://data.opi.mt.gov/bills/2007/billhtml/SB0007.htm">SB 7</a><br />n<br />nLegislative veto of administrative rules<br />n<br />n<blockquote>NEW SECTION. Section 1. Committee nullification of proposed or adopted rule. Upon the request of any person or a committee member, an administrative rule review committee may, after a public hearing and by a majority vote, disapprove of a rule adopted since final adjournment of the last regular session of the legislature or of a proposed rule. If disapproved, a rule that has been adopted ceases to be effective and a proposed rule is not effective if adopted. </blockquote><br />n<br />nNow this one is …… interesting to say the least. I'm assuming this particular bill is in response to a particular agency action but it does bring up a interesting point. Should a legislative body have veto power over an administrative, usually executive branch, rule? Then , "Upon the request of any person," so any Tom Dick or Harry can request this and tie the administrative rule up in procedural mumbo jumbo for months? <br />n<br />nIt's an interesting proposal but I would be curious at the Constitutionality of it. It all seems a little shaky to me. Wish I could be there for the hearings to hear more about this one.<br />n<br />nReferred to the Senate State Administration Committee.
